The DMCA is the Digital Millennium Copyright Act, a US law signed on 28 October 1998 as Public Law 105-304. Its Title II, the Online Copyright Infringement Liability Limitation Act, created section 512 of the US Copyright Act.
Section 512 gives online service providers "safe harbors": protection from money damages for what their users upload. To keep that protection, a host removes material quickly when a rightsholder sends a valid notice. This is the notice-and-takedown system, and the source of the "DMCA notices" that hosts receive.
DMCA ignored means the host does not remove content or suspend a server because of a DMCA takedown notice. The notice is a US procedure, and following it is a choice even for US hosts.
The US Copyright Office says so plainly: responding to takedown notices is always voluntary, and a provider, wherever it is hosted, is never obligated to comply. A host that complies keeps its safe harbor against US damages. A host that does not loses that shield, but this alone does not make it liable; a court must still find infringement.
OffshoreKVM is run by DomaineGoat LLC, a company registered in Panama, and its servers are in the Netherlands, Iceland, Switzerland and Romania. None of this is in the United States, so the US safe harbor is not the rule OffshoreKVM works under.
DMCA ignored: we do not act on DMCA notices or other foreign copyright notices. We answer only to Panamanian law and to orders of Panamanian courts.
Panama has its own copyright law, Law 64 of 10 October 2012, and has been a party to the Berne Convention since 1996. A Panamanian court can rule on a copyright case, and OffshoreKVM follows its orders. A notice emailed under a foreign law is not a Panamanian court order.
Nothing happens to your VPS. OffshoreKVM does not remove files, suspend the server or hand over your details because of a DMCA notice or any other foreign copyright notice.
Two things do lead to action:
What a host could hand over depends on what it keeps: No logs: we keep no connection logs, no traffic logs and no IP addresses of visitors or customers, on the website, the dashboard or the VPS. See can an offshore hosting provider be forced to hand over my data.
DMCA ignored covers copyright notices only. Every other rule stays in force.
No spam or bulk email, no phishing, no malware or botnet control, no DDoS or other attacks, no scanning or brute-forcing of other people’s systems, no booter or stresser services, no carding or fraud, no child sexual abuse material, no cryptocurrency mining, and no service to sanctioned people or companies. Outgoing port 25 (SMTP) is closed on every VPS to stop spam, and it stays closed. Ports 465 and 587 to mail providers stay open.
These uses harm other people and get IP ranges blocked for every customer, so OffshoreKVM suspends them. Reports go to [email protected]. The complete list is in the OffshoreKVM acceptable use policy.
Yes. OffshoreKVM is run by DomaineGoat LLC, a company registered in Panama, and answers only to Panamanian law. The datacenter that houses each VPS is in its own country and follows that country’s law. OffshoreKVM does not control the datacenter's own network equipment. A court or authority in that country acts through the datacenter, under its own law.
All four countries have their own copyright laws, and none of them is bound by the US DMCA.
| OffshoreKVM location | Country | Legal area |
|---|---|---|
| Amsterdam | Netherlands | European Union |
| Reykjavik | Iceland | EEA, outside the European Union |
| Zurich | Switzerland | Outside the EU and the EEA |
| Bucharest | Romania | European Union |
The DMCA policy is the same in all four. Which country suits your project is covered on which country is best for offshore hosting.
A minority do. According to OffshoreKVM's check of 29 October 2026, 7 of 36 active offshore VPS hosts advertise that they ignore DMCA notices. Others judge copyright notices under the law of the server's country, and some follow the DMCA process in full.
